Terms of Service

These Terms set out the conditions and procedures for using the Zzazan (ZzaZan) web service, cloud storage, shared albums and family groups, and the paid subscriptions sold on the web (the "Service") provided by WookLap (Representative: Taewook Kim; the "Operator", "we"), and the rights and obligations of the Operator and users.
The Zzazan iOS and Android apps are distributed on the App Store and Google Play by the seller shown in each store, and the license to use the apps is governed by each store's terms (such as Apple's standard license agreement). These Terms apply to the cloud storage, shared albums and family groups you use in the apps with the same account, and to paid web subscriptions.
Paid subscriptions are supplied by the Operator and sold by our reseller Paddle as the Merchant of Record (Article 6). Our Privacy Policy governs personal data, and our Refund Policy governs refunds.
This English text is a convenience translation. The Service is operated under the laws of the Republic of Korea, and the Korean version prevails in the event of any discrepancy, except where the mandatory law of your country requires otherwise.
Article 1 (Purpose and definitions)
- These Terms set out the conditions and procedures for using the Service, and the rights, obligations and responsibilities of the Operator and users.
- In these Terms:
- Service means the cloud storage, shared album and family group features the Operator provides through its websites and web service, and the paid subscriptions sold on the web. It includes the cloud storage, shared albums and family groups you use in the Zzazan apps when signed in with the same account
- App means the Zzazan (ZzaZan) iOS and Android apps distributed on the App Store and Google Play
- User ("you") means a person who uses the Service under these Terms
- Shared album means an album you view together with people you invite ("Group" in the app)
- Family group means a group that shares cloud storage. It consists of one owner and the members the owner invites, with no limit on the number of members. A family group does not share photos or videos among its members (photos and videos are viewed together in shared albums)
- Paid subscription means a subscription, renewed automatically every month, that increases your cloud storage
- Reseller means Paddle, which processes orders, payments, taxes and refunds as the Merchant of Record for paid subscriptions (Article 6)
- Matters not covered by these Terms are governed by applicable law and general commercial practice.
Article 2 (Posting and changing these Terms)
- We post these Terms where you can easily find them, linked from the front page of the Service's website.
- We may change these Terms to the extent permitted by applicable law, including the Korean Act on the Regulation of Terms and Conditions and the Act on the Consumer Protection in Electronic Commerce.
- When we change these Terms, we announce the changes, the reason and the date they apply on the Service's website (this page) at least 7 days in advance. For changes that are unfavorable to you or otherwise material, we announce them at least 30 days in advance, and where applicable law requires it, we also notify you separately in the way it requires.
- If you do not agree to the changed Terms, you may cancel your paid subscription or request account deletion before the changes apply. If our notice under paragraph 3 stated that you will be deemed to have accepted the changes unless you object before they apply, and you do not object, you are deemed to have accepted the changed Terms.
Article 3 (What the Service provides)
- We provide the following features:
- Cloud storage — backing up original photos and videos to the cloud
- Shared albums — viewing photos and videos together with the family members you invite ("Group" in the app)
- Family groups — sharing cloud storage with your family (photos and videos are not shared)
- The App's photo organizing features (recognizing faces on your device to gather a child's photos from your gallery, and picking the best shot from each set of similar photos) run on your device, and face recognition data is not stored on our servers.
- The App and its photo organizing features are free. Accounts signed in with a social account get 10 GB of cloud storage for originals free of charge.
- A paid subscription increases your cloud storage. Plans differ only in storage; everything else is the same whether or not you subscribe. The storage and price of each plan are shown on our Pricing page and at checkout.
- Accounts started without signing in (guest) do not get cloud storage, shared albums, family groups or server sync; photos and videos are stored only on the device.
- Paid subscriptions are sold only on the web. Nothing can be purchased inside the app, and a plan you subscribe to on the web also applies in the app when you sign in with the same account.
Article 4 (Accounts)
- The Service is intended to be used by parents and guardians (adults). Children do not sign up for the Service themselves; the guardian registers and manages the child's photos and information.
- You can create an account by signing in with a social account we support, or start without signing in (as a guest). A guest account can link a social account later.
- You are responsible for your own social account and devices, and must not let others use your account. If you suspect your account has been compromised, tell us right away.
- A shared album invite link can be used by anyone who has it — not only the person you sent it to — until it expires (7 days after it is issued), so check where you send it.
Article 5 (Paid subscriptions)
- Paid subscriptions renew automatically every month. At each renewal, the charge for the next period is made to the payment method you provided, until you cancel (Article 7).
- Prices are shown on our Pricing page, and checkout shows the billing cycle and the final amount including tax. Tax is charged by the reseller, as the seller, under the law of the country where you purchase.
- An account can have only one paid subscription, and it is paid for by the account signed in to the web service (the owner of the family group). While you are a member of someone else's family group you cannot start a paid subscription; leave that family group first.
- An upgrade to a higher plan applies immediately, and the difference for the rest of the period is charged according to the reseller's proration. A downgrade to a lower plan applies at the end of the current billing period; until then you keep the storage of your current plan.
- If a renewal payment fails, the reseller retries the payment for the period it sets, and you keep your paid benefits during that time. If the payment ultimately fails, the subscription ends and your account moves to the free plan, and the 30-day grace period in Article 9 begins.
- If we increase the subscription price, we will tell you before it applies and, as applicable law requires, ask for your consent or give you the chance to cancel.
Article 6 (Orders and payment — our reseller Paddle)
- Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
- The payment transaction for a paid subscription is therefore between you and Paddle, and it is also governed by the Paddle Buyer Terms and the Paddle Refund Policy. Your use of the Service is governed by these Terms.
- The Paddle entity you transact with depends on where you purchase:
- United States — Paddle.com Inc. (3811 Ditmars Blvd. #1071, Astoria, New York, NY 11105-1803, USA)
- Canada — Paddle.com (Canada) Ltd. (22 Adelaide Street West, Suite 3400, Toronto, Ontario, M5H 4E3, Canada)
- Rest of world, including Korea — Paddle.com Market Limited (incorporated in England and Wales, company number 8172165, 30 Old Bailey, London, EC4M 7AU, United Kingdom)
- The full card number and security code (CVC) are entered on Paddle's checkout and handled by Paddle; they are not passed to the Operator, and the Operator neither receives nor stores them. Paddle's transaction notifications to the Operator may carry a summary of the payment method — such as its type, the card brand, the last four digits of the card number, the expiry date and the name on the card — which the Operator does not store (Privacy Policy, Article 1(4)). Payment confirmations and receipts are sent by Paddle.
Article 7 (Cancelling a subscription)
- You can cancel your paid subscription at any time. Cancellation takes effect at the end of the current billing period, and you will not be charged again after that. You keep your paid benefits until the end of the billing period.
- You can cancel in any of these ways:
- Open the Paddle customer portal from the "Manage subscription" link in your subscription confirmation email and choose "Cancel subscription".
- Request cancellation at paddle.net.
- Email us at support@zzazan.ai. We will cancel the subscription and let you know.
- If your usage exceeds the free plan's storage after cancellation, Article 9 applies.
Article 8 (Withdrawal and refunds)
- The conditions and methods for withdrawal and refunds are set out in our Refund Policy. In short:
- If you ask within 14 days of a payment (including a renewal payment), we refund that payment in full.
- Where applicable law gives you a better right (such as the right to withdraw under the Korean Act on the Consumer Protection in Electronic Commerce, or the 14-day right of withdrawal for consumers in the EU and UK), that right prevails.
- After 14 days you can cancel (Article 7); partial refunds for a billing period that has already started are made only where required by law.
- Refunds are processed by Paddle as the seller. When a refund is processed, the paid benefits provided by that payment end immediately, and if your usage exceeds the new limit, the 30-day grace period in Article 9 applies.
Article 9 (30-day grace period and deletion after a plan goes down)
- If your plan goes down because of cancellation, a downgrade, a refund or a failed payment, and your usage exceeds the new plan's storage, a 30-day grace period begins. It counts from when the plan actually changes (for cancellations and downgrades, the end of the billing period), or from when we learn of the change if that is later. We do not delete photos over the limit without notice.
- When the grace period begins, we pick items to be deleted that add up to the excess, and show you the items, their size and the deadline. By default, the items backed up to the cloud earliest are picked first. Until the deadline you can change the picked items, download photos, clean up yourself (delete permanently or empty the trash), or subscribe again.
- If you subscribe again or clean up so that your usage is within the limit during the grace period, the grace period ends and nothing is deleted.
- If you are still over the limit at the deadline, we permanently delete the picked items one at a time and stop as soon as your usage is within the limit. Because deletion is per file, you may end up below the limit by up to the size of the last item. Because you have already had 30 days, deleted items do not go to the trash again.
- We send in-app notifications when the grace period begins, when the picked items change, 7 days and 1 day before the deadline, and when deletion starts and finishes.
- Photos and videos stay with the account that owns them even when a family group is dissolved. Only the account whose limit counts that storage changes.
Article 10 (Your content)
- You (or the original rights holder) keep the rights to the photos, videos and other content you put in the Service. The Operator does not acquire those rights.
- You allow us to use your content only as needed to provide the Service — storing and backing it up, making converted images for display, and delivering and showing it to the people you choose to share with. We do not use your content for purposes other than those set out in these Terms and the Privacy Policy, and this permission ends when you delete the content or when your account deletion is complete.
- You must have the rights needed for the content you upload, and respect the rights of other people who appear in photos you share.
- When you stop sharing or revoke a permission, access through our servers is blocked immediately, but originals that shared-album members have already downloaded cannot be recalled. Photos you add to someone else's shared album may be stored in the album owner's cloud; in that case, deleting the original is up to the album owner (Privacy Policy, Article 6(1)).
Article 11 (Prohibited conduct)
- You must not:
- upload or share child sexual abuse material, non-consensual intimate images or other content prohibited by law
- infringe other people's rights, such as copyright, portrait rights or privacy
- use another person's account or invite links without authorization
- disrupt the normal operation of the Service, for example by making abnormal volumes of requests or circumventing security measures or storage limits
- do anything else that violates applicable law
- If you break these rules, we may, in accordance with applicable law, block the sharing of or remove the content concerned, restrict your use of the Service, and report to the relevant authorities where the law requires. We will tell you what we did and why, and you can object through the contact in Article 17. We may not tell you where the law prohibits it.
Article 12 (Changes, interruptions and limits on warranties)
- We may change features to improve the Service, and we announce changes that are unfavorable to you in advance under Article 2.
- The Service may be interrupted temporarily for maintenance or replacement of equipment, failures or loss of communications. We announce planned maintenance in advance where possible.
- If we stop providing the Service or paid subscriptions, we will tell you in advance, and paid subscriptions with time remaining will be handled in accordance with applicable law and our Refund Policy.
- To the extent permitted by law, the Service is provided as is. We do not warrant that the Service will be uninterrupted or error-free.
Article 13 (Limitation of liability)
- We are not liable for losses caused by natural disasters or similar force majeure, by causes attributable to you (such as failing to secure your account or device, or leaking an invite link), or by failures of third-party services we do not control (such as social login providers, device operating systems or networks), unless we acted intentionally or negligently.
- To the extent permitted by law, we are not liable in connection with the free parts of the Service unless we acted intentionally or with gross negligence.
- Nothing in these Terms limits the rights that applicable law guarantees to consumers.
Article 14 (Account deletion)
- You can request account deletion in the app at any time (Manage → Account → Delete account). If you cannot sign in to the app, you can request it by email; see Account deletion for details.
- Accounts signed in with a social account are deleted after a 30-day grace period, during which you can cancel the deletion. Accounts used without signing in (guest) are deleted right away, without a grace period.
- Requesting account deletion does not by itself cancel a paid subscription, and payments continue until it is cancelled. If you have a paid subscription, cancel it as described in Article 7 and check that it has been cancelled before you request account deletion.
- What is deleted, what remains after deletion and for how long, are set out in Article 7 of the Privacy Policy and on the Account deletion page.
Article 15 (Contracts with minors)
- A minor needs the consent of a legal guardian to pay for a paid subscription. If a minor enters into a paid subscription contract without the legal guardian's consent, the minor or the legal guardian may cancel that contract.
- The Service is intended to be used by parents and guardians (adults) (Article 4).
Article 16 (Governing law and disputes)
- Disputes between the Operator and users about the use of the Service are governed by the laws of the Republic of Korea. This does not limit rights that the law of the country where you live mandatorily guarantees to consumers.
- We receive and handle complaints and requests for redress through the contact details in Article 17, and if we cannot resolve a matter right away, we tell you why and when we expect to. You may also apply for mediation to a consumer dispute body such as the Korea Consumer Agency.
- Lawsuits between the Operator and users are subject to the exclusive jurisdiction of the district court for your address at the time the suit is filed (or your residence, if you have no address). If your address or residence is unclear at that time, or you live abroad, the suit is filed with the court that has jurisdiction under the Korean Civil Procedure Act.
- Disputes about the payment transaction for a paid subscription (the transaction between you and Paddle) follow the governing law and procedures set out in the Paddle Buyer Terms.
